The purpose of this privacy policy is to explain to users of the MenuChic SaaS solution (“hereinafter MenuChic”) and its MenuChic Manager application, in accordance with the legislation in force, the efforts made to protect the personal data of users and guarantee the confidentiality of those -this as well as data for which we act as a subcontractor. 


The purpose of this page is to provide information on the data collected by MenuChic and its MenuChic Manager application, the objectives pursued justifying the processing thereof and the rights available to users. 


Lexicon 


"User" means a natural or legal person who has signed up a contract with MenuChic and/or uses the MenuChic Manager application.


"End users" means the natural or legal persons contracting with the users of the MenuChic SaaS solution and whose certain data may be collected on the MenuChic Manager application for its proper execution. 


1 - Collected data and pursued objectives 


The objective of the collected data is to enable users to register and connect to the MenuChic solution and its MenuChic Manager application in a secure manner and to be able to use its functionalities. They can also be used by our teams to send information emails on new features or actions to be taken to ensure the continuity of the features offered by the application (important updates for example) or to improve the experience. of the user.


In this context, we collect and are directly responsible for processing the following data from our users: 


  • name

  • First name

  • Email address

  • Telephone number

  • Products and services entered by the user

  • Turnover of goods and/or services managed through the application 

  • Statistical data of the goods and/or services managed through the application 


Furthermore, within the framework of the functionalities of MenuChic and the MenuChic Manager application, and in order to ensure the proper performance of the contract between the user and his end users, we may be required for the latter to collect the following data as a subcontractor:


  • name

  • First name

  • E-mail address

  • Telephone number

  • Details of orders made 

  • Details of reservations requested

  • Messages sent

  • Data relating to the number of orders or reservations made 

  • Information on diets and allergens


2 - Means of collecting your data


User data is collected either during the first registration to MenuChic and/or the MenuChic Manager application through the dedicated form, or during their exchanges with our sales teams.


The collection of data relating to the smooth running of the contracts of our users with their end users, and for which we act as a subcontractor, is carried out at the time of the realization of the said contract between the user and his end users and are considered as consented by all parties within the framework of the general conditions of sale provided to its end users by the user. 


No other data is collected by the application or by our teams without the explicit consent of the persons concerned and they will only be used for the legitimate objectives defined with them. 


3 - Storage period and user rights


To ensure the proper functioning of the MenuChic Manager application and allow users to connect to their account, we keep user data for the duration of use of the application.


Our employees and subcontractors may only have access to user data to the extent necessary to ensure the execution of the objectives pursued and defined in point 1.


Users have the right at any time to verify, access, rectify, delete, transfer and oppose the use of their data by contacting us at dp@menuchic.com. We will then make every effort to satisfy your request.


4 - Cookies


We also collect cookies to ensure the security and good continuity of our services, are concerned: 


  • the date and time of connection of a user

  • the IP address of the medium used to access the application


5 - Obligations and security


The teams working for MenuChic undertake not to transmit the data collected directly as data manager or indirectly as a subcontractor to third parties without the user having been informed and to respect the purposes for which this data was collected.


The application has an SSL certificate to ensure that the information and data transfer passing through the application is secure.


In addition, the data controller undertakes to notify the user in the event of rectification or deletion of the data, unless this entails disproportionate formalities, costs and procedures for him.


In the event that the integrity, confidentiality or security of users’ or end users’ data is compromised, the controller undertakes to inform the user by any means.


6 - Data  hosting


The hosting data collected is hosted by the company DigitalOcean LLC, domiciled at 01 Avenue of the Americas, 10th Floor New York, NY 10013. The servers used are located within the European Union in Germany (Frankfurt) . 


7 - Sharing of data


MenuChic Manager does not share the collected data other than for the purpose of ensuring the proper functioning of the solution. 


Data, such as the IP address and type of devices used by our users, is collected and shared encrypted and anonymously with our error reporting software (Sentry). 


8 - Policy relating to data concerning minors


The MenuChic Manager application is not intended for minors and does not collect personal data except for those voluntarily provided by our users' end users. If a minor child has provided data without consent, contact us at the following address so that we delete it as soon as possible: dp@menuchic.com


9 - Acceptance and modification of this privacy policy


By using the MenuChic SaaS solution , the user certifies having read and understood this privacy policy and accepts its terms. 


This confidentiality policy may change in order to guarantee its compliance with the law in force and the user is invited to consult it on a regular basis.


10 - Right to refer to the competent supervisory authority


In the event of a dispute over the processing of data, we encourage our users to approach our teams in order to find a satisfactory solution.


The user is entitled to contact the CNIL (Commission Nationale de l'Informatique et des Libertés, https://www.cnil.fr) or any competent judge.
